Personal Injury Law – Auto Accidents

When you are involved in an automobile accident you have two claims moving forward simultaneously.  The first is your Personal Injury Protection or PIP Claim otherwise known as No-Fault.   The other is your Bodily Injury Claim.

Personal Injury Protection-PIP

PIP benefits provide for medical benefits and lost wages.  All automobiles insured in Massachusetts are required to carry PIP coverage that protect the operator and the passengers of the insured vehicle or any pedestrian struck by the insured vehicle*.

PIP medical benefits will provide for the first $2,000.00 of reasonable and necessary medical treatment resulting from the accident. PIP benefits will pay up to $8,000.00 in medical benefits where a claimant does not have health insurance or a claimant’s health insurance company does not provide for the medical service rendered.  Additionally, PIP benefits will pay 75% of your average weekly wage while you are totally disabled from your employment.

Insufficient Insurance: If the person who caused your injuries does not have insurance, or inadequate insurance to cover your damages, you may be entitled to collect uninsured or underinsured coverage from your own automobile policy or a family member’s automobile policy.

PIP medical benefits will provide for the first $2,000.00 of reasonable and necessary medical treatment resulting from the accident.   If you have private health care insurance, Massachusetts Law requires that medical bills in excess of $2,000.00 be submitted through your provider for payment. If you do not have private health care insurance, or if your health care insurance company refuses to pay your medical bills, you may be entitled to up to $8,000.00 in PIP medical coverage.

Bodily Injury: If you have more than $2,000 in medical bills, a fracture, or other serious injury, you may be entitled to compensation for injuries, including scarring, pain and suffering, permanent or partial disability, and loss of ability to enjoy life. Wrongful death claims are also compensable under Massachusetts motor vehicle laws.

*Be aware of purchasing auto insurance on-line.  Many new insurers in the Commonwealth are taking advantage of the recent deregulation/competitive _________ in Massachusetts.  They are advertising and selling cheaper premiums by selling you a “PIP deductible.”  In essence for a $10-$20 savings you are giving up $8,000.00 in benefits!  The only time you become aware of this is after you had an accident and your insurance company refuses to pay your medical bills and lost wages.
